LAW GOVERNING ADOPTIONS IN NEW JERSEY
The adoption of children is governed by New Jersey Statutes which seek to promote a state policy of promoting the best interest of the children. The "best interest of the children" standard controls the adoption process as well as the maintenance of stable continuing relationships between parent and children. Adoptions involving a child from one state being placed in New Jersey or visa versa are governed by the interstate compact on the placement of children which has been adopted by the State of New Jersey by statute.
Adopting a Child in Foster Care
When a foster child cannot be returned to his or her birth parents, it is the responsibility of state and local agencies to find a permanent home for the child. One of the most obvious solutions is for the child to be adopted by his or her foster parents. As a foster parent who is considering adoption, or a prospective parent considering the adoption of a child in foster care, here are some legal issues to be aware of. TESTIMONIAL
First of all, I just wanted to thank you so much for the time, and most of all, for the knowledge, concern and support you so generously gave me during our meeting on May 26, 2010. I walked out of your office feeling much more confident and very relieved. I'm not sure how you will take this, but you are an extraordinary human being and the antithesis of the stereotypical lawyer. A usually skeptical person, I trusted you from the moment I shook your hand! In addition, every member of your staff with whom I came in contact with was courteous, respectful, and helpful. You and your partner have created a very special environment, and you should be commended.

PERSONS WHO MAY ADOPT
The determination of who may become an adoptive parent is often made by an approved adoption agency by screening applicants and making placement. An approved agency must establish and make available written criteria for eligibility to adopt.
This requirement is specified in the New Jersey Administrative Code. Prospective adopting persons must have the capacity to meet the child’s physical and emotional needs and be of good physical and mental health.
The law mandates that an approved agency must use the best interests of the child as the standard in selecting adoptive parents. Furthermore, an agency may not discriminate with respect to the selection of adoptive parents for any child on the basis of age, sex, race, national origin, religion or marital status but these factors may be considered determining whether the best interest of the child are served by a particular placement or adoption.
Neither New Jersey law nor public policy prohibits joint adoption of a child by someone of the same sex as the birth parent. If a birth mother’s same sex partner petitions to adopt the birth mother’s child, the petition may be granted if it is in the child’s best interest.A petitioner's sexual orientation is a factor to be considered but it is dispositive only when it adversely affects the child.
TESTIMONIALS
"Mr. Niemann has been a god send to me and my family. He has met with me many, many times with patience, sensitivity and understanding that few people expect from an attorney. My family issues are complex and Mr. Niemann understands what I want to happen to my estate upon my death especially for my adult incapacitated child and other adult children. He created a special trust for my son. He has followed up with me to help me make decisions without forcing his opinions on me. In the end, he told me, "Jerri, my job is to explain your choices and help you understand the legal effect of those choices". He guides me and puts me at ease. He wants you to make decisions that are the right ones for you."

TESTIMONIAL
Fred is an amazing and dynamic person. I have attended a few of his work shops and CEU events over the years and his interactive discussions have been both educational and entertaining. He is one of the few lawyers out there that I do trust and does whatever he says he is going to (Accountability) who ever I have referred his way has always thanked me for connecting them and this is why I continue to work w/ Fred. Great person, excellent ethics, and very knowledgeable. I highly recommend him.
